DMCA Notice and Takedown Process

1. Summary

Granite Ridge Realty respects the intellectual property rights of others and follows the procedures set out in the Digital Millennium Copyright Act (DMCA) for handling copyright infringement claims arising from content submitted to the Flathead Valley Directory.

2. Submitting a Takedown Notice

If you believe content on the directory infringes your copyright, send a written notice to our Designated Agent listed in Section 6. Notices may be sent by email and should reference "DMCA Takedown Notice" in the subject line.

Upon receiving a valid notice, we will remove or disable access to the allegedly infringing content while we evaluate the claim, and we will notify the user who submitted the content.

3. Required Contents of a Notice

A valid takedown notice under 17 U.S.C. § 512(c)(3) must include:

1. A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the specific URL(s) on the directory where the infringing material is located, with enough detail to permit us to locate the material.
4. Your contact information: name, address, telephone number, and email.
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

4. Counter-Notice

If you believe your content was removed or disabled in error, you may submit a counter-notice to the Designated Agent. A counter-notice under 17 U.S.C. § 512(g)(3) must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location at which it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the United States District Court for the District of Montana, and that you will accept service of process from the person who submitted the takedown notice.

If we receive a valid counter-notice, we will forward it to the original complaining party. The material may be restored 10 to 14 business days after receipt unless the original complaining party files a court action against the user.

5. Repeat Infringers

It is our policy to terminate accounts of users who are determined to be repeat infringers under appropriate circumstances.

7. Penalties for Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages. Submit notices and counter-notices in good faith.
